Definitions

“9patch”, “We” or “Us” Andreas Éri, August-von-Willich Str. 19, 50827 Köln, Germany with VAT number DE302464157;

“Services” our website https://www.getassetstudio.com (“our website”), our software products (“our apps”), our support service;

“License Key” a unique code provided by 9patch, which enables You to activate our apps and to subsequently use our apps during the applicable license term;

“Use” the access, download, install, copy or get benefit from using our apps;

1. Introduction

In the following data protection declaration we inform you about the extent to which data is collected and received through our Services, our support service, and about how we use, share, retain and protect such personal data.

2. Who we are

9patch is the operator responsible for the processing of personal data through our Services. We are responsible for compliance with the statutory provisions on data protection as per the German Federal Data Protection Act (BDSG) and in our function as a service provider in the sense of the Telemediengesetz (TMG).

3. What are personal data

Personal data are individual details of personal or factual circumstances of a particular or identifiable natural person. This includes information such as for instance your name, address, telephone number or date of birth. Statistical information that cannot be directly or indirectly associated with you are not personal data.

4. Data we collect and how we use it

We may collect the following data when you use our Services:

  • Software License Service
    In order to verify and validate your trial and subscription license and device usage count We store the following data with our Software License Service:
    • Pseudonymized device identifier (count device usage)
    • Subscription data (e.g. verify and validate subscription status)
    • Trial data (e.g. verify and validate trial status)
    • Fulfillment data (License Key)
    • Order data (e.g. email, product)

  • Purchase data
    We collect information from you when you decide to buy one of our apps. The payment provider (FastSpring or Apple, depending on which version of an app you buy) will ask you for the necessary information to complete your purchase. We will receive your purchase and necessary subscription data which will be saved in our Software License Service described above. We do not have access to the details of your payment.

  • Logfiles
    When you use our App, the web servers store the connection data of the requesting device by default and temporarily for system security purposes. This record consists of:

    Date, time and IP address of the access,
    Information about the content you retrieve with 9patch.

    These data are stored anonymously according to the Telemediengesetz (TMG). These data cannot be attributed to specific persons. This data is not merged with other data sources. We reserve the right to review these data at a later date, if concrete
    indications of unlawful use become known to us.

5. Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser. When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

6. Information we share and with whom we share it

We do not sell, trade, or otherwise transfer to outside parties, your personally identifiable information. This does not include trusted third parties who assist us in operating our Services, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.

7. Data Storage

Files are stored locally on the device. Our apps creates a file folder for this purpose and saves the files there. License and trial data for frequent verification will be saved on the device filesystem.

8. App Sandboxing

In order for you to use all the features of our apps, the application must be able to access various functions and data on your device. In the following, we will inform you about the enabled Sandbox options:

  • (Not used in AppStore Version) Network outgoing connections: Use for update request and to download update artifacts. Apart from that different requests to manage and maintain the whole license and trial lifecycle.
  • Read and write file access for user selected files: Use for import and export of image data.

9. Data Security

We take technical and organizational security measures to protect your data against unauthorized access. In addition to safeguarding the operating environment, we use encrypted transmission methods. In this case, the information you provide will be encrypted in order to prevent misuse of the data by third parties.

10. Use of Service Providers / processing of data in countries outside the European Economic Area

We use service providers to provide our services and to process your data (amongst others to host your data in a secure data center, send letters, e-mails or push notifications, as well as the maintenance and analysis of databases, so-called contract data processing as per § 11 BDSG). The service providers process the data exclusively on our instructions and are obliged to comply with the applicable data protection regulations. All contract data processors have been carefully selected and receive access to your data only to the extent and for the required period of time, which is necessary for the performance of the services or to the extent that you have consented to for the processing and use of the data.
The servers of some of our deployed service providers are located in the US and other countries outside the European Union. Companies in these countries are subject to a data protection act which does generally not protect personal data to the same extent as is the case in the Member States of the European Union. If your data is processed in a country that does not have a level of protection as high as the European Union, please ensure to read the linked privacy policies in Paragraph 4.

11. Information, rectification and deletion of your data

Upon request, you will be informed about the data we store and how they are used. If your data is incorrect, we will correct it. In this regard, you can contact us at the address mentioned in Paragraph 12, or in any other way. You can also view the data which we have stored about you in your profile via the Internet and correct it if necessary. You have the right to block and delete the data on your person that are stored with us. Should the deletion be contrary to contractual, tax, commercial law or other statutory storage obligations, only the blocking of your data may be executed instead of the deletion.
